Terms and Conditions of Sale

Suppliers of goods and services and Buyers using the Marketplace are required to read and accept these Terms and Conditions of Sale, in particular the following sections: 4 Right of withdrawal, 5 Customer cancellation, 6 Supplier cancellation and, for Suppliers only, section 8 Selling on the SharryLand Marketplace.

1 - Purchasing on the SharryLand Marketplace

1.1 - Introduction. Any User (hereinafter also referred to as the Customer) wishing to purchase or book Experiences, Travel Packages, Local Products or Services through the Marketplace of SharryLand’s Map of Italy's hidden Wonders is required to read and accept, in addition to the Platform’s Terms and Conditions of Use, these Terms and Conditions of Sale.

1.2 - Who the Supplier is. The User acknowledges that the SharryLand Marketplace directly connects supply and demand, Customers and Suppliers, and provides the technological infrastructure and tools required to select, book and purchase items and to complete the sale or booking. Experiences, Travel Packages, Local Products and Services are offered by third parties. When making a purchase or booking, the Customer enters into a contract directly with the Supplier. SharryLand is not a party to the sales contract and is not involved either as a buyer or as a seller of the Experiences, Travel Packages, Local Products or Services covered by the contract. The Supplier’s name and a link to their Profile, including their contact details, are always clearly displayed on the Detail Page of the relevant Experience, Travel Package, Product or Service.

1.3 - Who the Customer is. Any User wishing to make a booking or purchase through the SharryLand Marketplace must be at least 18 years old. Users who are not yet registered with SharryLand may also use the Marketplace.

1.4 - What is available on the Marketplace. The Marketplace was created as a tool for the economic development of rural and inland areas located outside the traditional tourist routes.

1.4.1 - Experiences, Travel Packages, Local Products and Services. The Marketplace includes Experiences in rural and inland areas, such as, by way of example only, guided tours, excursions, creative workshops, tastings and cookery classes; experiential Travel Packages in rural and inland areas; local food, wine and creative craft products; and services useful to visitors. Experiences, Travel Packages, Products and Services are sold directly by Suppliers, such as guides, farms, associations, travel agencies and professionals, in accordance with SharryLand’s philosophy and objectives. SharryLand reserves the right not to publish Experiences, Travel Packages, Products or Services that do not comply with its philosophy or quality standards.

1.4.2 - Exception: accommodation. Accommodation providers in rural and inland areas, including B&Bs, agritourism establishments, garnis, historic residences, guest houses and other non-hotel accommodation facilities, including scattered hotels, may appear on A Map of Italy's hidden Wonders with a geolocated and verified Pro Profile containing a link to their own booking system. In this case, Customers wishing to make a booking or purchase will be redirected to the accommodation provider’s booking and/or sales system, outside the SharryLand Marketplace.

1.5 - Prices. Prices are set by the Supplier, are expressed in euros and include VAT and any other applicable taxes. Prices may be fixed or provided on the basis of a personalised quotation. Some Experiences may be free of charge and require only a booking, with no payment. Some Experiences may involve a responsible contribution or a voluntary donation. Any transfer of money between the parties involved in an Experience must comply with the applicable tax legislation. In the case of Travel Packages, local taxes and/or charges may be payable on site.

1.6 - “Ciliegioso” Discount Vouchers and Gift Cards. Customers holding “Ciliegioso” Discount Vouchers or Gift Cards may use them for purchases on the SharryLand Marketplace before the expiry date indicated on the Voucher or Gift Card and in accordance with the instructions provided.

1.7 - Payments. Payments on the SharryLand Marketplace are securely processed through Stripe. Stripe is the platform selected by SharryLand s.r.l. Società Benefit as its partner for the secure management of transactions and related data. SharryLand does not have direct access to the Customer’s or Supplier’s bank details. The order amount is transferred from the Customer’s card to the Supplier’s Stripe account. Payment methods other than those indicated on the order summary page, namely the basket or checkout page, are not accepted.

1.8 - Order management. Since SharryLand is not a party to the contract between the Customer and the Supplier, the Supplier is responsible for managing the Customer’s order and, in the case of products, for arranging shipment or collection from its premises. The Customer must contact the Supplier directly, rather than the SharryLand Marketplace, to obtain additional information about the Experiences, Travel Packages, Products or Services covered by the contract and about the shipment or delivery date. In order to contact the Supplier and enable SharryLand to monitor the purchasing experience, the Customer must use the messaging system provided by SharryLand, accessible from the “My purchases” page.

1.9 - Personal data. To complete a purchase or booking, the Customer may be asked to provide specific information, such as a delivery address or telephone number. The data collected will be processed in accordance with the GDPR (see the Privacy Policy) and solely for the purpose of performing the contract.

1.10 - Basket. The Customer may add Experiences, Travel Packages, Products and Services offered by different Suppliers to the basket and make a single payment. If, after purchasing a travel service, the User books additional travel services through SharryLand, the User will NOT benefit from the rights applicable to Travel Packages under EU Directive 2015/2302.

1.11 - Cancellation and withdrawal. In the event of cancellation or withdrawal, the applicable legislation and the terms set out below shall apply. The Customer must initiate the procedure from the “My purchases” section. Any refund due will be credited to the card used to make the payment.

2 - The Marketplace and SharryLand’s role

2.1 - The SharryLand Marketplace, integrated into “A Map of Italy's hidden Wonders”, aims to promote Italian destinations outside the traditional tourist routes, particularly rural and inland areas, and to support the development of green & slow tourism through the direct sale, based on a short supply chain, of Experiences, Travel Packages, Local Products and Services offered by local professionals, with particular attention to quality, sustainability and authenticity.

2.2 - SharryLand does not organise, offer, sell or manage, nor does it act as an intermediary in the organisation, offering, sale or management of, Experiences, Travel Packages, Products or Services proposed by professional operators through the Marketplace. Each Professional Operator is therefore solely responsible for the organisation, offering, sale and management of the Experiences, Travel Packages, Products and Services concerned, including responsibility for holding all qualifications, permits, licences and any other authorisations required to carry out the proposed activities, in compliance with all applicable laws and regulations.

2.3 - SharryLand does not, in any capacity, become a Party to contracts concluded directly between the Supplier and the Customer, which therefore bind only the Users concerned. The Supplier authorises SharryLand to collect payments on its behalf; however, SharryLand assumes no responsibility for the sales contract or for the proper performance of the obligations set out therein and does not act in any way as the Supplier’s agent.

3 - Standard terms and conditions

3.1 - Applicable legislation

The Supplier undertakes to comply with the applicable legislation, the Consumer Code (Legislative Decree No. 206/2005) and the legislation governing electronic commerce (Legislative Decree No. 70 of 9 April 2003). For Travel Packages and linked travel arrangements, the applicable legislation is Legislative Decree No. 62/2018. Any matter not expressly covered by these Terms and Conditions of Sale shall be governed by the legislation referred to above.

3.2 - Age of majority

To buy and sell on SharryLand, Users must be at least 18 years old and registered with SharryLand. Registration is free of charge. Persons under the age of 18 may participate in Experiences and Travel Packages provided that they are accompanied by at least one adult participant, who need not be registered with SharryLand and who assumes responsibility for them.

3.3 - Purchasing procedure

3.3.1 - Registration with the SharryLand platform. Use of the Marketplace requires free registration with SharryLand in order to enable the management of transactions, communications between the Customer and the Supplier, reviews and other related activities. At the time of purchase or booking, an unregistered User will receive an access code and a temporary password by email and may complete the registration process during checkout or at a later stage.

3.3.2 - The Customer selects Experiences, Travel Packages, Products and Services by consulting the Detail Pages available on the Marketplace. The Supplier undertakes to include on the Detail Page all information required by the Customer to make an informed choice.

  • For Experiences and Travel Packages: a detailed description, photographs, what is included, accessibility, whether animals are permitted, participation and payment arrangements, insurance, customisation options, dates and times, prices and price ranges, and any other relevant information.
  • For Products: a detailed description, photographs, available variants according to the type of product, such as colour, weight, size and quantity, as well as shipping methods, delivery times and costs, and any other relevant information.

3.3.3 - The Customer also obtains directly from the Supplier, and not from SharryLand, any information and documents relating to insurance, assistance, shipping and any other supplementary documentation.

3.3.4 - The Customer may combine in a single basket Experiences, Travel Packages, Products and Services offered by different Suppliers and make a single payment corresponding to the total amount of the individual orders. The conditions of use, delivery times and shipping costs are clearly indicated for each Item during the purchasing process and summarised in the basket. Where provided for by the Supplier, the Customer may also request customisation of the service or product.

3.4 - Accepted payment methods

The accepted payment methods are indicated in the basket and include credit cards, debit cards, prepaid cards (Visa, Mastercard, American Express and UnionPay), Apple pay, Google pay, Klarna instalment payments and other methods. Payment is made at checkout. Payment by instalments through Klarna is available for amounts exceeding EUR 60.

3.5 - Conclusion of the contract

The contract is concluded between the Customer and the Supplier. The purchase contract is deemed to have been concluded when the Supplier receives confirmation of payment.

3.6 - Delivery of products in Italy

The Supplier must provide a home delivery shipping service for products sold through the marketplace. In addition to home delivery by courier, the Seller may also offer collection from its premises. Home delivery is currently available only within Italy.

3.7 - “Ciliegioso” Discount Vouchers

By carrying out certain activities on the platform, SharryLand Users collect merit points expressed in Cherries. Upon reaching specific milestones, the Cherry points provide benefits, including “Ciliegioso” Discount Vouchers, which may be used to purchase Experiences, Products and Services on the SharryLand Marketplace. The rules governing the Discount Vouchers are set out on a dedicated page accessible from the SharryLand platform menu.

3.8 - Processing of personal data

Pursuant to Article 7 of Legislative Decree No. 196 of 30 June 2003, as subsequently amended, the personal data provided by the Customer will be processed, including by electronic means, solely for the purpose of performing the contract correctly, fully and promptly. Such data may be disclosed, for the same purposes, to third parties that are competent and duly authorised in relation to the subject matter of this contract.

3.9 - Insurance

The Supplier must comply with all legal requirements concerning mandatory insurance for Experiences and Travel Packages and may offer additional optional insurance services. The Supplier must provide the Customer with clear and comprehensive information about mandatory and optional insurance coverage and must upload and keep the insurance documents on the Detail Page up to date.

3.10 - Assistance

The Supplier may receive requests from the Customer for customisation, clarification or refunds. The Supplier undertakes to reply within 2 working days.

For Experiences and Travel Packages, the Supplier provides Customer assistance throughout the entire period during which the service is provided, in accordance with the applicable legislation and with any information specified on the Detail Page published on the SharryLand Marketplace.

3.11 - Dispute resolution

3.11.1 - In the event of disputes between the Customer and the Supplier relating to the online sale or purchase of products or services through the SharryLand platform, the Customer may refer the dispute to the competent ADR entities, namely alternative dispute resolution entities included in the relevant registers established under applicable European and national legislation.

3.11.2 - The Consumer’s right to bring proceedings before the competent Judicial Authority remains unaffected. Where the Parties intend to bring proceedings before the ordinary courts, jurisdiction will generally lie with the court of the Consumer’s place of residence or elected domicile, pursuant to Article 33(2)(u) of the Italian Consumer Code.

4 - Right of withdrawal

4.1 - Travel Packages. Experiences and Trips sold by a Tour Operator or Travel Agency, including “SharryLand Trips”, qualify as Travel Packages. The Customer has the right to withdraw from the contract within 48 hours of the date on which the contract was concluded, without incurring any penalty and without providing any reason (Article 41(7) of Legislative Decree No. 62/2018).

4.2 - Local food, wine and craft products. The Customer has the right to withdraw from the purchase contract within 14 days of receiving the Product. Where the right of withdrawal is exercised within the time limits and in the manner prescribed by law, the Customer is entitled to a full refund, including any shipping costs paid at the time of purchase. The Customer must return the Product in optimal condition. The cost of returning the Product shall be borne by the Customer (Article 52 et seq. of Legislative Decree No. 206/2005). The Customer must return the Product using a shipping method that provides a tracking code. Without a tracking code, the Customer may be unable to prove that the returned Product was shipped and could therefore lose the right to a refund.

4.3 - The right of withdrawal does not apply to the purchase of Products from the same Supplier where the total consideration does not exceed EUR 50, namely low-value contracts (Article 47(2) of Legislative Decree No. 206/2005).

4.4 - The right of withdrawal does not apply in the cases provided for by Article 59 of the Italian Consumer Code, including:

  • the supply of goods made to the Customer’s specifications or clearly personalised;
  • the supply of goods that are liable to deteriorate or expire rapidly;
  • the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery;
  • services relating to a specific date or period of performance, such as car rental services, catering services and services connected with leisure activities, where the contract provides for a specific date or period of performance.

5 - Customer cancellation

5.1 - Where the Customer is unable to participate in the purchased Experience or Travel Package or to use the booked Service, the Customer must promptly inform the Supplier and may receive a full or partial refund as set out below.

5.2 - SharryLand monitors the refund procedure, where a refund is due, to ensure that it is completed within the required time limit, namely within 14 days of notification of the cancellation.

5.3 - EXPERIENCES

In the event of cancellation of the Experience by the Customer, the following conditions shall apply:

  • Full refund where cancellation is notified more than 48 hours before the scheduled date
  • No refund where cancellation is notified less than 48 hours before the scheduled date or where the Customer fails to participate in the Experience (“no-show”)

The same conditions apply to Experiences sold under the “SharryLand Trips” brand.

5.4 - TRAVEL PACKAGES

In the event of cancellation of a Travel Package including accommodation, the following conditions will generally apply to the Customer, unless otherwise agreed in writing in the contract between the Tour Operator and the Customer:

  • Full refund where cancellation is notified 35 or more days before the scheduled departure date
  • 50% refund where cancellation is notified between 34 and 10 days before the scheduled departure date
  • No refund where cancellation is notified during the 9 days preceding the scheduled departure date

The same conditions apply to Travel Packages sold under the “SharryLand’s Travels” brand.

5.5 - PRODUCTS

5.5.1 - Customer dissatisfaction. The Customer may submit a complaint where the Product has not been received within 30 days of the order, unless otherwise agreed between the Parties; where there are significant discrepancies between the information provided on the Detail Page and the Product received; or where the Product is defective or spoiled.

5.5.2 - Complaints must be promptly submitted to the Supplier using the form available on the “My purchases” page. In the form, the Customer must explain the reason for the complaint and attach any relevant photographs. After consulting the Supplier, the Customer will, where appropriate, return the Product using a shipping method that provides a tracking code. The cost of returning the Product shall be borne by the Customer. Without a tracking code, the Customer may be unable to prove that the Product was shipped and could therefore lose any right to a refund.

6 - Cancellation by the Supplier

6.1 - Where the Supplier cancels the Experience or is unable to provide the Product or Service covered by the contract, the Supplier must promptly inform the Customer and refund the amounts received, as set out below.

6.2 - SharryLand monitors the refund procedure to ensure that it is completed within the required time limits.

6.3 - EXPERIENCES AND TRAVEL PACKAGES

6.3.1 - Where the Experience is cancelled by the Supplier, the Customer will generally be entitled to a full refund.

6.3.2 - Where the Supplier cancels the Experience, particularly an outdoor Experience, due to adverse weather conditions or another reason concerning the Customer’s safety, the alternative specified by the Supplier on the Detail Page will apply: a full refund, rescheduling to another date, generally by 30 October of the current year in the case of Travel Packages, an alternative programme, or another solution.

6.3.3 - Where the Supplier cancels the Experience or Travel Package due to natural disasters or force majeure events, such as earthquakes, floods or wars, the solution will be agreed between the Customer and the Supplier and may consist of a full refund, rescheduling to another date, an alternative programme, or another solution.

6.3.4 - Refunds under the conditions set out above are generally issued within 14 days of notification of the cancellation.

6.4 - PRODUCTS

Supplier’s inability to fulfil the order or delay. Where the Supplier is unable to accept an order or the Product is unavailable, the Supplier must promptly notify the Customer and issue a refund, including any shipping costs paid in advance at the time of purchase. The Supplier also undertakes to promptly notify the Customer of any delay in the delivery of the Product, which is generally expected to take place no later than 30 days after confirmation of the order.

7 - SharryLand Gift Cards

7.1 - What a Gift Card is. A Gift Card is a digital gift voucher issued by SharryLand s.r.l. Società Benefit. Gift Cards are available in different denominations (€10, €50, €100, etc.). Each Gift Card consists of a unique code and is valid for 12 months from the date of purchase. It is not issued in a specific person’s name and may be transferred to another person.

7.2 - Who may purchase a Gift Card. Any User with access to the Marketplace may purchase a Gift Card.

7.3 - Purchasing a Gift Card. On the Gift Card purchase page, the User must select the amount and an image from the available options. The User may also add a personal message. The User must provide the recipient’s name and email address and specify the date on which the Gift Card is to be sent. On the selected date, SharryLand will send the Gift Card by email to the recipient, with a copy also sent to the sender.

7.4 - Using the Gift Card

7.4.1 - The SharryLand Gift Card may be used only on the www.sharry.land platform and the SharryLand app to purchase “SharryLand Trips” and/or products or services sold directly by SharryLand. The option to use Gift Cards to purchase products and services sold by Suppliers other than SharryLand will be introduced at a later date.

7.4.2 - Once the item to be purchased has been selected, the unique Gift Card code must be copied and pasted into the relevant field.

7.4.3 - If the cost of the item exceeds the value of the Gift Card, the difference must be paid using another accepted payment method.

7.4.4 - If the cost of the item is lower than the value of the Gift Card, the amount will be deducted from the Gift Card and the remaining balance may be used to purchase other eligible items until it has been fully used.

7.4.5 - No additional charges apply when using a Gift Card.

7.5 - Refund arrangements for purchases made using a Gift Card

7.5.1 - Where a refund is due for a purchase made using a Gift Card, the Terms and Conditions of Sale set out in this document shall apply.

7.5.2 - The amount to be refunded will be credited back to the same Gift Card, up to its original value, without any additional costs or fees.

7.5.3 - If a User who made a purchase using a Gift Card is entitled to a refund exceeding the original value of the Gift Card, the refund will be credited back to the Gift Card up to its original value, without any additional costs or fees. The remaining amount will be credited to the payment method used by the User when making the purchase, and any applicable fees may be charged.

7.6 - Transferability. A Gift Card may be freely transferred to another person simply by communicating or transferring the numerical code shown on it.

7.7 - Combination with other Gift Cards or offers. Gift Cards cannot be combined with one another. However, in certain cases they may be used in conjunction with promotions or other discount vouchers where this is expressly indicated.

7.8 - Restrictions and validity.

7.8.1 - A purchased Gift Card is non-refundable, except where the right of withdrawal applies pursuant to Article 52 of Legislative Decree No. 206/2005.

7.8.2 - Digital Gift Cards and any remaining balance may be used within 12 months of the date of issue, which coincides with the date of purchase. Once the 12-month period has expired, any remaining amount may neither be spent nor refunded.

7.8.3 - A Gift Card cannot be reloaded. It cannot be exchanged for cash.

7.9 - Loss or theft. A Gift Card must be treated with the same care as cash. SharryLand accepts no responsibility in the event of loss, theft or unauthorised use.

7.10 - Fraud. Where a User knowingly or unknowingly uses a fraudulently generated Gift Card, SharryLand reserves the right to refuse the sale or charge the amount to another payment method provided by the User and will assess what action to take against those responsible for the fraud.

7.11 - Malfunction. If the unique Gift Card code does not work, the User may contact the SharryLand Support Centre to request a replacement.

7.12 - General provisions. The sale of Gift Cards is governed by the Terms and Conditions of Sale contained in this document and by SharryLand’s Terms and Conditions. Gift Cards are issued by SharryLand s.r.l. Società Benefit, Piazza F. Facchetti 12, 35013 Cittadella (PD), Italy. VAT No. 05096140289 - www.sharry.land. The purchase and use of a Gift Card and these conditions of use are governed by Italian law.

8 - Selling on the SharryLand Marketplace

8.1 - Requirements applicable to the Supplier and to the goods and services sold

8.1.1 - Who the Supplier is. The Supplier is a professional operator whose registered office and operational headquarters are located in Italy and who uploads Experiences, Travel Packages, Products or Services to the SharryLand Marketplace for sale or booking.

8.1.2 - Requirements. Only professional Users who hold the necessary qualifications and authorisations may use the Marketplace to promote and sell Experiences, Travel Packages, Products and Services. These include, by way of example only, a tourist guide licence for guided tours or a Travel Agency or Tour Operator licence for Travel Packages. To access the Marketplace as Suppliers, operators must be registered on the SharryLand platform with a Professional Profile. Their Profile must contain all relevant information, be verified by the Editorial Team and be linked to a Stripe account. The Editorial Team verifies Professional Profiles that comply with the platform’s quality standards and philosophy.

8.1.3 - Communications with the Buyer. Through the SharryLand Marketplace, the Supplier may receive orders, bookings and requests for information or for the customisation of a product or service. The Supplier undertakes to fulfil orders as quickly as possible, and in any event no later than one month after confirmation, and to respond to requests within 2 working days.

8.1.4 - Types of goods and services. The Supplier may offer for sale Experiences, Travel Packages, Products and Services that are consistent with SharryLand’s philosophy and objectives. Products must be handcrafted and typical of the area in which the Supplier is based. Experiences are offered by guides, experts and local associations and are intended to promote knowledge of the natural and cultural heritage of rural and inland areas and non-tourist areas, for example through excursions, tastings and creative workshops. Services must relate to the local area, including, by way of example only, basic bicycle or equipment hire, babysitting and dog-sitting. Travel Packages are offered by Italian Tour Operators or Travel Agencies specialising in incoming tourism and must have rural and inland areas as their destination. Accommodation providers and service providers, such as private hire vehicle operators and bicycle hire companies, are not directly present on the Marketplace but may appear on the platform with a geolocated Profile containing a link to their booking system. In such cases, the booking is managed outside the Marketplace.

8.1.5 - Local Products. The SharryLand Marketplace offers agricultural and food and wine Products, herbal products and traditional or creative craft items made locally. They must be stored in warehouses or shops located within Italy. They may be collected from the Supplier’s premises or delivered to the Customer’s address. They can currently be delivered only within Italy. The Supplier undertakes to provide the Customer with a tracking code for shipped Products.

8.2 - Marketplace activation procedure

8.2.1 - Registration. To be present on the Marketplace of the Map of Italy's hidden Wonders, Suppliers must register on the SharryLand Platform with a Professional Profile. The personal and tax information uploaded by the Supplier to the SharryLand Platform is processed in accordance with the GDPR (see the Privacy Policy).

8.2.2 - Legal and tax information. The Supplier must enter complete legal and tax information in its Profile and guarantees that such information is truthful and accurate. The Supplier must also promptly update it whenever any changes occur. Where required by the applicable legislation, the SharryLand platform may transmit the Supplier’s information to the Italian Revenue Agency.

8.2.3 - Professional qualifications and mandatory certifications. The Supplier certifies that it holds all the qualifications and authorisations required and complies with all legal requirements applicable to the provision of the proposed services. The Supplier must also promptly update the relevant information whenever any changes or updates occur.

8.2.4 - Stripe account. To ensure the secure management of transactions, Suppliers must activate a Stripe account or link an existing Stripe account to their SharryLand Profile. Personal, banking and tax information provided to Stripe is processed in accordance with the Stripe Services Agreement. SharryLand does not have access to this information.

8.3 - Procedure for adding content to the Marketplace

8.3.1 - Detail Pages (Product Page / Service Page). To upload Experiences, Travel Packages, Local Products and Services, the Supplier must complete every section of a Form so as to provide the Customer with all the information required to make an informed choice. For Experiences and Travel Packages: a detailed description, photographs, what is included, accessibility, whether animals are permitted, participation and payment arrangements, insurance, customisation options, dates, prices and other relevant information. For Products: a detailed description, photographs, available variants according to the type of product, such as colour, weight, size and quantity, together with shipping methods, delivery times, shipping costs and other relevant information.

8.3.2 - Contract and documents required by the Customer. Where applicable, for example in the case of a Travel Package, the Supplier undertakes to provide the Customer with all necessary documentation, including the contractual terms, insurance documents and any other supplementary documents, when the contract is confirmed and concluded.

8.3.3 - Verification. Detail Pages are published on the Marketplace of the Map of Italy's hidden Wonders only after verification by the SharryLand Editorial Team. In order to provide the Customer with the best possible service, the Supplier agrees to cooperate with the Editorial Team and provide all necessary information. The SharryLand Editorial Team reserves the right not to publish Content that does not comply with SharryLand’s quality standards and/or objectives, or Content uploaded by an operator that has not demonstrated that it meets the legal requirements for access to the service.

8.3.4 - Publication and online distribution. Following verification, Detail Pages are published on the Marketplace in 5 languages and geolocated. They may appear in search results based on title, subtitle, keyword, location or interest. They also appear on the Supplier’s Profile Page. They are public and may be indexed by search engines, shared on social media and embedded in other websites through widgets. In certain cases, at the discretion of the Editorial Team, some Detail Pages may not appear in search results but will remain accessible through a direct link or widget.

8.3.5 - Updating Detail Pages. The Supplier may independently update certain sections of the Detail Pages. For example, for Experiences, the Supplier may update calendar dates, times and prices; for Products, availability, prices and delivery methods. To change descriptive sections or photographs, however, the Supplier must contact the Editorial Team using the “Report a Change” function available in the submission form for each Detail Page or by contacting the Support Centre.

8.3.6 - Suspension of Detail Pages. Without prejudice to the rights of Users who have already purchased or booked the relevant product or service, the Supplier may temporarily or permanently suspend Product and Service Pages published on the SharryLand Marketplace. Suspended Pages will no longer be visible on the Marketplace and may be reactivated by the Supplier at any time. The Supplier is responsible for informing any Users who have purchased but have not yet received the product or service concerned. SharryLand reserves the right to suspend sales by Suppliers that engage in improper conduct towards Customers or the Platform.

8.3.7 - Product shipping methods. The Supplier must indicate the shipping methods and costs on the Detail Page; undertakes to ship purchased Products as quickly as possible and in any event no later than one month after order confirmation; and undertakes to package the Products securely and ship them using a tracking system, including a tracking code, for the protection of both Parties. In the absence of a tracking code, a Customer who submits a complaint for non-delivery will be entitled to a refund. Products can currently be shipped only within Italy.

8.4 - Economic and tax matters

8.4.1 - Indemnity. A Supplier wishing to offer and sell Experiences, Travel Packages, Local Products or Services through the Marketplace of SharryLand’s Map of Italy's hidden Wonders enters into a binding obligation towards the Customer to perform the purchase contract in accordance with the applicable legislation and is required to accept, in addition to the Platform’s Terms and Conditions of Use, these Terms and Conditions of Sale, thereby indemnifying and holding SharryLand s.r.l. Società Benefit harmless from any liability arising from failure to comply with the applicable contractual terms.

8.4.2 - Authorisation to collect payments. In order to ensure the successful completion of the transaction and protect the Customer, the Supplier expressly authorises SharryLand to collect the amounts relating to the sale of goods or services.

8.4.3 - Payment arrangements. SharryLand holds the amounts paid by the Customer in a deposit account until the Service, Experience or Travel Package has been provided. For Products, SharryLand holds the amounts paid by the Customer in a deposit account for the average period required to ship and receive the Products and to exercise the right of withdrawal, where applicable. This period is generally estimated at 30 days from confirmation of the order. Once this period has elapsed, SharryLand will credit the amounts due to the Supplier, less the Marketplace service charge and Stripe fees.

8.4.4 - Invoices and receipts. The Supplier is responsible for issuing the Customer with an invoice or receipt for the purchase of the Product or Service.

8.4.5 - Costs for the Supplier. A Supplier using the SharryLand Marketplace as described above does not pay any access fee. Only when a sale is completed, the SharryLand platform deducts at source 10% of the transaction value, including VAT, as the Service charge. The Stripe platform deducts at source, on average, 1.5% + EUR 0.25 for standard cards issued within the European Economic Area, calculated on the amount actually transacted. At the end of each month, the SharryLand platform issues a summary invoice showing the Service charges, namely 10% including VAT, and the Stripe fees, which are not subject to VAT. Please note: the Marketplace Service charge is not invoiced to the Supplier where the Customer uses a “Ciliegioso” Discount Voucher.

8.4.6 - “Ciliegioso” Discount Voucher. To encourage use of the Marketplace and support the purchase of products and services offered by Suppliers, SharryLand has introduced a points collection system, known as the Cherry-o-Meter (Ciliegiometro), which entitles the Customer to obtain a “Ciliegioso” Discount Voucher for use on the Marketplace. The “Ciliegioso” Discount Voucher provides a 10% discount and applies to the total amount of the basket. The discount is granted by SharryLand, which waives the Marketplace Service charge.

8.4.7 - Refund Service. SharryLand monitors refund procedures in order to safeguard the Customer’s rights. In accordance with the arrangements described in Section 4 - Right of withdrawal, Section 5 - Customer cancellation and Section 6 - Cancellation by the Supplier, SharryLand initiates the procedure for refunding the amount relating to the relevant Product or Service, whether in full or in part. Where necessary, SharryLand advances any shortfall and subsequently recovers the amount from the Supplier. Amounts advanced constitute a service not subject to VAT pursuant to Article 15 of Italian Presidential Decree No. 633/1972. The cost of the Service provided by SharryLand, equal to 10% of the transaction value, and the Stripe fees remain payable by the Supplier.

8.4.8 - Security deposit. Where refund requests occur frequently, SharryLand reserves the right to require the Supplier to pay a security deposit, which will remain available to cover refunds and withdrawals.
